The FLSA white collar overtime pay exemptions are not new but many employers are still struggling to understand them. Indeed, misclassification litigation is on the rise and even companies that believed that they were in compliance are finding themselves in court. As if that is not enough, the DOL has declared that it will further increase its enforcement efforts. Also, Wisconsin’s wage and hour agency was recently vested with broad authority to investigate employee misclassifications. In light of all of this, employers must be doubly careful when declaring any employee an exempt employee. This presentation will address these issues and: how you can avoid the most common classification mistakes; the white collar exemption criteria; best practices for identifying employees correctly; the salary docking rules; and the penalties for violations.
